"Staying" The Devil

AHRC (the American Homeowners Resource Center) lives! And it lives unencumbered by the Devil's shackles!

Peters & Freedman
, a California law firm that is NOT on the side of HOA homeowners, attempted a takeover of the AHRC website (owned by Elizabeth McMahon for the last 18 years) through what appears to have been two bogus legal claims (lawsuits), ie, the violation of Mrs. McMahon's Constitutional freedom on speech rights, and that AHRC, through its writers, had " defamed" others in their postings / writings on AHRC.

Peters & Freedman lost in their attempt to do that (see article below).

Peters & Freedman lawyers did what CAI (Community Associations Institute) lawyers all over this nation -- including Colorado (whose major CAI branch officesare in Denver) -- have been doing for quite some time to homeowners. That is, file what appears to be meritless lawsuits against homeowners to (or so it certainly appears) run the homeowners out of moneyas they try to defend themselves against those bogus lawsuits -- often in District courts whose judges appear to be acting in concert with such devil's-children lawyers. The CAI's improper and destructive-to-homeowners strategy being that when they succeed in ruining a homeowner financially, the homeowner becomes absolutely defenseless. At that point, CAI lawyers can (and regularly do) foreclose on the homeowner's home and then "take" the homeowner for every cent the homeowner has worked hard for all of his or her life.

However, since AHRC is the national voice of We The People homeowners, this time We the People all over this nation spoke out in one loud and clear voice against such (we believe) improper attorney behaviors. And this time, this particular California Appeals Court listened -- at least for the moment.

Chalk up a big win for HOA homeowners nationwide on this one!

CALIFORNIA COURT OF APPEAL STAYS THE TAKING OF AHRC.COM
Dramatic, last minute ruling

In a dramatic, last minute ruling, a California Court of Appeal has stayed the takeover of AHRC.com. In a terse order, the Court of Appeal stayed the trial court's order to takeover AHRC.com pending further briefing. Network Solutions was scheduled to turnover AHRC.com to the law firm of Peters and FreedmanandPalacio del Mar Homeowners Associationwithin a few hours.

This is to inform you that the California Court of Appeal, Fourth Appellate District, Division 3 in Santa Ana, California has just issued an Order staying the orders of April 10 and May 8, 2008 by the trial court in Case # 01CC14684 - Palacio v McMahon. I am attaching a printout of the website of the Court of Appeal for your reference. I will forward the formal notification when I receive it from the Court.
