Judge, Jury and Executioner

When someone is said to be a "judge, jury, and executioner," it means they are in charge of every decision made, and they have the power to do anything they choose to anybody they choose. HOA presidents and county sheriffs, for example, are said to have such power in Colorado.

Remember the lady I wrote about recently who lives in a Colorado HOA who had a concealed carry permit for a number of years without incident? Then, the last time her permit came up for renewal, her county's sheriff refused to renew it? And that his "reasoning" for that refusal appeared to be disingenuous (false) since e-mails between him and the HOA president during that time seem to indicate that he may have been "politically connected with" the president of her HOA?

Should that sheriff and that HOA president have had the power to act as judge, jury, and executioner in that case?

And do readers here remember that the president of the Colorado lady's HOA is a wealthy California developer / builder who built a million-dollar "home" in her HOA that he doesn't live in, and who may have had something "shady" (illegal) to do with recent wealthy lot / parcel buyers choosing his HOA in which to build very large million-dollar-plus "homes" that, as it turns out, may not be "homes" at all, but real estate investments with which they hope to make lots of money under the guidance of the wealthy and very-experienced-at-such-things HOA president / California developer / builder?

Should that HOA president have the power to use his wealth to act as a dictatorial judge, jury and executioner in his HOA?

And that this same HOA president / wealthy developer / builder is now a member of the City Council in a small city near his and the Colorado lady's HOA? And that he is the owner of at least two large houses in that city and some kind of a lodging place, as well as the owner of more than one business along the main street of that city? And that, as a member of the City Council, he is pushing his City Council cohorts hard to approve many California-style housing developments, i.e., wall-to-wall houses, in and around that city, while at the same time talking about changing his (and the Colorado lady's) HOA covenants to allow two or more "guest houses" or "accessory houses" on each parcel in their currently peaceful and quiet rural residential community to be used as "rental units" -- just as one would expect to find in any crowded and crime-ridden city?

Should that HOA president have the power to use his wealth to act as judge, jury and executioner in terms of manipulating population growth, housing, and city business affairs? (one can only wonder if all of the intelligent and rational voters in that city have left in disgust).

And that this same HOA president has also been making "water storage" deals for his HOA with the powers-that-be in the city in which he sits as a member of the City Council? Deals that would provide the water necessary for new lakes and ponds in his (and the Colorado lady's) residential community to be used for fishing and boating recreational activities among the HOA's members and their "guests" and renters? And that the entire HOA membership would have to pay for any "deals" about water storage (thousands and thousands of dollars) that her HOA president might make, whether or not some or many of the members agree with such drastic changes in the Colorado lady's HOA, i.e., extraordinary and unnecessary costs and ecological damage to a rural community?

Should that HOA president have the power to use his wealth to enable him to act as judge, jury and executioner in manipulating a change in his HOA from a naturally beautiful rural residential community to a barren commercial development?

And that this same Colorado HOA president / developer / builder has already done all of the above in his California housing development HOAs, along with providing RV (recreational vehicle) parks for wealthy folks to come to during their travels around the world so that they can rest their weary bones sitting in a small rented boat with a rented fishing pole in their hands? And that these wealthy RV owners will pay "out the nose" not only for the rental of the boats and fishing gear, but for every fish they catch which, of course, makes the wealthy developer / builder / HOA president and his HOA cohorts even wealthier?

Question: Might that kind of behavior be considered to be a pathological power-and-money-seeking type of behavior?

Answer: Yes, it appears that it would. But worse, the wealthy California HOA president / developer / builder is now freely demonstrating that apparently psychopathological behavior right here in our beautiful state of Colorado.

While the particular details of each HOA scam in our country may be different than the above-mentioned HOA, such judge, jury and executioner HOA scams are going on all over our nation. Here in Colorado, for example, power-and-money-seeking legislators in Denver put the laws in place in 1992 that first made it possible for HOA presidents and their cohort HOA members to do pretty much anything that they want to do in housing developments (called "homeowners associations" or "HOAs") without fearing any adverse legal consequences whatsoever. Further, less than stellar local public officials and certain lawyers (many, if not most, of whom are members of the Community Associations Institute (CAI)) also seem to be "in on the action," greasing the way for HOA presidents, developers and builders to do whatever they want to do in their homeowners associations without much opposition (other than from HOA homeowners like the Colorado lady).

In other words, power-and-money-seeking HOA presidents and elected public officials -- with the help of their followers / cabals and their state legislators -- really do have the power to act as judges, juries and executioners in anything and everything they say or do.And that kind of government (or any other governing body) usually goes by the name "Fascist".

That being so, it would appear that it would behoove all voters here in Teller County to investigate, very closely, the people in their county who run for any public or private (such as in an HOA) office before they elect them. For example, each voter should ask him- or herself these questions: What do I really know about [a particular candidate for office], other than what he or she tells me? Have I talked to a candidate's enemies as well as a candidate's friends? Have I run a simple-to-do background check on the candidate myself? Have I followed that up with a more in-depth check if questions arise from the initial check? Am I satisfied that I have done everything possible to try to elect an honest person with integrity to the office he or she seeks? Or will I just apathetically wait, without a murmur of dissent, for the power-and-money axe to fall on my neck in the form of new taxes, increased HOA assessments, and more and more control over my life -- perhaps not even recognizing that the person that I voted for is among those responsible for the increase in my taxes, an increase in the control over most areas of my life, and an increase in lots of other ecological and financial negatives in my life?

Smiling and seemingly agreeable public officials and HOA presidents who are pathologically driven to act as judge, jury and executioner: Will they, do they, stab you right in the back (ecologically and financially), and then try to control your life? Yes, they will. And they do, regularly. Worse, they are now prevalent in every state throughout the United States. And worse than that, the taxpayer / homeowner eventually picks up the tab (costs) for his or her own undoing.

How much longer are honest, law-abiding residents / voters in Teller County going to put up with such shenanigans in our own county? Or is it already too late to do anything about it? That is, are there already more of "them" (pathologically-motivated power and money seekers and their followers) here in Teller County than there are of "us" (normal law-abiding residents whose only wish is to live in Constitutional freedom and liberty)?

One small hope for Coloradans is that thousands of HOA homeowners all over this nation are already publicly and nationally speaking and writing about their terrifying-to-any-freedom-loving-homeowner HOA experiences.That is, they are informing the public -- facts and law -- about exactly where their HOAs are located, who all the power-and-money-seeking "players" in their HOAs are, and will publicly answer any questions anyone may have about their terrible but not-uncommon HOA experiences.Many, if not most, HOA homeowners throughout Colorado will be able to relate completely to the tyranny those homeowners have endured at the hands of their HOA presidents, boards of directors, and their member cabals.And because they can relate so completely, they will begin to realize that they are not alone in their own pain and suffering at the hands of their own HOA's dictators.Then, together, Colorado homeowners / voters can do something about their state's homeowners associations. That is, bypass their legislature with the initiative process and abolish homeowners associations throughout the state of Colorado.

But who is this particular lady who lives in a Colorado HOA?What is the name of her HOA? Where is her HOA located? Who is the president of her HOA? What are the names of the HOA president's cohorts?
