Three Colorado Appeals Court Judges heard Oral Arguments in my lawsuit against my HOA on Tuesday, November 25, 2008.
The Court's audio recording of those legal arguments will be available soon (15 minutes by my attorney and 15 minutes by my HOA's attorney). When that audio file becomes available from the court, I will post it here, verbatim.
Then, the audio file will be posted on many hundreds of other web sites, both in Colorado and nationally.
As you listen to the audio of those oral arguments, remember that the attorney for my HOA was (and perhaps still is) the attorney for an HOA in Colorado Springs, Colorado, whose board of directors tried to force its members to sign an unAmerican loyalty oath. He apparently stood silently by while the HOA board of that HOA demanded that "loyalty oaths" be signed by the homeowners who lived in that HOA.
I will try to get some feedback from the homeowners themselves in that HOA, if I can, to find out exactly what happened there. All I have seen about it so far (in writing) are local newspaper reports.
Fascism anyone?
Also remember that
the HOA's HOMEOWNERS WON their lawsuit against their HOA concerning their HOA board's unAmerican "loyalty oath' activity -- the judge in the case severely chastising the HOA board members in his decision about it.
Back to my lawsuit which is now in the Colorado Appeals Court.
The completion of Oral Arguments means that nothing more will need to happen in order for the Appeals Court judges to make their decision in my case.
Hopefully, it will be soon. When I see a copy of it (that I will get from my attorney), I will also post that decision here, again verbatim, as well as on major web sites throughout Colorado and our nation.
Hang in there, Coloradans !! Every day, We The HOA Homeowner People are learning more and more about what certainly can be described as one of our more egregious American Tragedies: homeowners associations.
