Lakewood property owners began receiving RTD's offers for property takings at the beginning of April. Those facing a taking have 90 days to counter RTD's offer and settle before facing eminent domain.
Many property owners have unanswered questions, are unfamiliar with the appraisal process and their options to be made whole.
We're holding a community meeting to help understand the property acquisition process. We are very lucky to have Mr. Gregg Near, MAI, SRA, Certified Appraiser, who has offered his time freely to help answer questions.
Independent appraisals for eminent domain takings
can cost thousands so this is a great benefit not only for those by Lakewood's West Corridor but also
Commerce City property owners near the proposed North Metro Corridor Rail Line.
The most common questions:
1. Why can't I get a compensated independent appraisal?
2. RTD's offer for my land seems low compared to other property takings in public projects. What do I do?
3. I have negative impacts and my setbacks will be out of conformity, I haven't been offered any compensation. What are my options?
4. RTD is taking part of my property, the offer is under $5000 so I don't get a compensated appraisal. RTD is also cutting off access to my property without showing compensation for this damage. What do I do?
5. RTD said they won't pay me for damages because they'll offset those using the special benefit 50% rule. What is this?
