SIGNS: SIGNS: EVERYWHERE SIGNS
Contributed by: DR. SEAN REIF D.C. on 3/26/2007

Signs attract attention and provide advertising and information. A local sign ordinance is a special kind of design review ordinance that may restrict the type, size, and location of signs as well as sign materials. The control of signs is a matter of safety and keeping the community "looking good." Ordinances restrict advertising signs which could create traffic problems and visually clutter an area. Large bright signs can distract drivers; a jumble of signs detracts from the town's appearance. But to attempt to control the CONTENT of signs is to risk violating the sign owner's U.S. Constitutional Right of Free Speech GUARANTEED under the FIRST AMENDMENT.

Many towns have prohibited signs above a certain height or signs which extend beyond certain distances from a building. Some towns have outright PROHIBITED billboards and portable signage.

A fair and successful way to eliminate NON-CONFORMING signage is to impose a time limit of 3 - 5 years for owners to remove or replace the offending signs. This causes no immediate hardship and gives owners reasonable time to make their signs conform to the sign ordinance.
