Live with your commitment

An open letter to Jacob Smith and Mary Weaver,

I am extremely disappointed in your decision to forego your commitment to serve your term of office as ward councilors and run for the office of Mayor of Golden.

In January of 2006 you took an oath of office that states that you will support the Constitution of the United States and the State of Colorado and Charter and Ordinances of the City of Golden.

The City Charter clearly states that councilors SHALL (shall is considered to be mandatory) be elected for a four year term.

There are provisions in the Charter whereby you could terminate your commitment to your office. You could move out of your ward, move out of the city, resign, be convicted of a felony, or die.

There are no provisions in the Charter that permit you to run for one elected office while holding another office. Therefore, I recommend that you resign from your ward councilor position prior to the upcoming election on November 6 th.

As a long time resident of Golden I am not pleased with the prospect of having to pay for a special election to fill your ward seat just to satisfy your ego-driven quest to be mayor.
