GMHS incident -- West Metro's response

Editor's note: YourHub.com requested a copy of the report of the Dec. 6 incident at Green Mountain High School. Here is the response from West Metro Fire Rescue, who is handling the investigation.


West Metro Fire Rescue has received your request for a copy of the investigation report for the call at GreenMountainHigh School in December 6, 2006. Because of the ongoing criminal case, I can't release the report at this time.

I can tell you that as sworn peace officers, our fire investigators are ethically and legally obligated to investigate such incidents and apply appropriate charges using the Col orado Revised Statutes when arresting people. According to our laws, a crime was committed. It may be helpful for you to have the definition of fourth degree arson, which states, "A person who knowingly or recklessly maintains a fire or causes an explosion on his own property or that of another and by doing so places any building or occupied structure in danger of damage."


Despite a person's character or likeability, our officers must enforce the law when, by definition, a crime has occurred; we cannot dismiss a crime o f any severity simply because some feel it wasn't really a big deal. Many of the significant incidents of crime in our community have histories of seemingly innocent or mild prank-like activities that open the way to more severe crimes. And, keep in mind that like most investigations, there are many other facts relevant to the case that remain confidential throughout the legal process, but that played a significant role in the arrest of the two individuals.


It is up to the judicial system to see the case through prosecution and West Metro Fire Rescue is confident in the court's ability to administer fair consequences to the teens involved in this case.

This is exactly the pompous, officious, clerical-mentality that we DON'T WANT in our officials. Given such lack of judgement and capability, they should be paid less accordingly, and have their authority curtailed. I'm still surprised that their special election tax increase was approved, but such tiny numbers of voters participated that it really wasn't a "general" election.

I don't understand how the incident was termed a crime according to the CRS definition. Bubbling pressure that can remove the top from a 2 ounce bottle is not the same as an explosion. Every dictionary I've checked includes "violent" as part of the criteria. The CRS definition also says "AND by doing so places any building or occupied structure in danger of damage." It does not say "and/or" so it's a necessary element of the crime, and certainly no building or structure was in danger of damage. I'm sure there must be much more to the actual report than has been released, or this charge will have no validity.
