Anti-Amend. 47: Fraud and possibly criminal ads
Contributed by: Alan Beshany on 10/7/2008

All Coloradans should be angry about an anti-47 ad that claims it would take away rights workers have earned over 60 years. This statement is such a lie that some prosecutor somewhere should stand tall and indict the perpetrators of this fraudulent lie. Right to work is a right that ALL workers should always have under the American democracy. Amendment 47 PRESERVES a worker's right not to be compelled to join a union, nor have money taken out of his/her paycheck involuntarily.

I was always under the impression that false and fraudulent advertising, even political in nature, is a crime. The union weasels behind such an ad should be prosecuted immediately. Do we have any prosecutors with the guts to do the right thing?

I disagree with the statement from Alan Beshany. In fact, the reverse is true -- the backers of Amendment 47 have just been found to have violated campaign finance laws: http://www.rockymountainnews.com/news/2008/oct/16/amendment-47-backers-run-afoul-campaign-finance-la/ And, a Channel Nine News fact check found the pro-47 ad false: "QUOTE: All it does, it gives workers the right to choose for themselves whether or not they want to join a union (Graphic: 'Amendment 47 is about the freedom to choose') "TRUTH: This is false." http://www.9news.com/news/article.aspx?storyid=101957&catid=188 Here is a link to a site with information about Amendment 47: http://www.voteno47.com And, a site with info about Amendments 47, 49, and 54: http://www.protectcoloradosfuture.org/

The Colorado Labor Peace Act gives workers the right to vote for unity in the workplace by a supermajority vote. This vote does not require everyone to join the union, but because the agreement represents all employees of that company, whether members or not, they pay dues to cover the cost of that representation. What Alan here doesn’t tell you is that passing 47 would tie the hands of unions where non members wouldn't have to pay these small fees, ($10/week for UFCW workers) but the union would still be required to represent them in bargaining and grievances. It's always telling when one side throws around the word lie, when the very amendment being pushed isn't telling the truth its first sentence. Federal and state law are clear, no one can be compelled to join a union. Federal law also allows non members to be refunded any fees not spent solely on representation. Even the Independence Institute admits this quietly. John Erhardt
