The Ken Caryl Ranch Metropolitan District (KCRMD) Service Plan, established by a vote of the residents, in December of 1987 provides general guidelines for future operation of the District (see page 3).The Service Plan clearly states that the KCRMD will provide for parks and recreational facilities for the property owners and residents. More specifically for the operation and maintenance of three (3) pools (see page5).
The KCRMD Board of Directors has threatened to close the Bradford pool which is in direct violation of the Service Plan they were elected to implement. One of the reasons that KCRMD purportedly does not to have sufficient funds is that they have spent, from 2000 to 2007,
$685,061.64 in attorney fees, and $151,124 last year.
KCRMD sued the Plains Metropolitan District (PMD) for allegedly not carrying out an item in their Service Plan that suggests that the PMD build certain recreational facilities.
On the one hand KCRMD believes that the Service Plan of the PMD is not subject to change and is willing to sue, at great expense to our residents. On the other hand they are willing to violate our Service Plan by threatening to close the Bradford pool. This is both hypocritical and manipulative. They can't have it both ways. By deleting one item from the KCRMD budget, attorney fees, they can balance our budget, meet our Service Plan guidelines of providing three pools, and not require a tax increase to the residents.
This kind of reasoning by the Board of Directors is Municipal Socialism. The KCRMD has turned into a bureaucracy that gets larger than any resident could imagine. Citizens may feel that they have no control or are helpless to correct this situation but they can. Start now by simply voting NO on tax Amendment A & B and control their relentless spending and protect your Tax Payer Bill Of Rights (TABOR).
