Ken-Caryl Ranch is not lost

Dear Editor;

Signs are appearing around the Ken-Caryl Area that say "Save Ken-Caryl Ranch". Well Ken-Caryl Ranch is NOT lost. The only thing that is lost is your money. KCRMD has spent from 2000 to 2007 $ 685,061.64 in attorney fees.

I am asking you to vote NO on tax Amendments A and B. Amendment A asks for a mill-levy tax increase and Amendment B asks for a mill levy tax increase and removes the TABOR amendment requirements of accountability.

The reason I recommend a "NO" vote on A and B is because the KCRMD has spent our tax dollars on law suits and not on the community facilities that the Board of Directors were elected to maintain.

Of course, we all wish to take care of our community and services but there are other options to do that rather than giving KCRMD more tax dollars.

For a positive "Change" and the future health of our community vote NO on Amendments A and B. We can make a difference without more tax dollars.

No, Mr. Wilson. You still are avoiding the facts! KCRMD has spent just over $300,000 on their legal defense, NOT $685,000. I challenge you to present the real figures from now on. Please tell me more about what PMD did with the extra monies they collected over 20 years!! Did they put it aside so they could give it to their constituents for recreational facilities? No. They took it and spent it on whatever they pleased!! The real crooks here seem to be the PMD directors and board. Please don't try to convince me that we somehow forced them to sue us! I hope you finally update your fictional numbers, by the way. Jeff

Jeff; PMD had to sue KCRMD to stop the illegal annexation of PMD into the tax base for the KCRMD. A service plan is NOT a legal contract. It is a proposal to the governing jurisdiction, in this case, Jefferson County for what the buildrs hope to create. Nowhere in the United States has a service plan been upheld as a contract with mandated outcomes. This frivolous lawsuit has wasted over $685,000.00 of yours and my tax dollars which should have been spent on maintaining our 3 pools as a minimum. I hope this clarifies to you what the KCRMD board is doing with our money.

You are comparing apples and oranges, Mr. Wilson. A rational person would see the difference between the two cases! PMD *completely* neglected their duty to provide recreational facilities, while KCRMD has only *suggested* that they cut back to TWO POOLS INSTEAD OF THREE. Those two actions are fundamentally different. In the one case, it's taking money for something that was never provided; in the other, it is downsizing services due to budget constraints. Very different, indeed. Back to the question: Do you know what happened to the $3.5M?

Jeff; The KCRMD service plan provides general guidelines for future operation of the district specifically for the operation and maintenance of(3) pools. KCRMD has threatened to close the Bradford pool which is in direct violation of of the KCRMD service plan they were elected to implement. KCRMD has spent $685,061.64 on attorney fees. KCRMD sued the Plains Metropolitan District for allegedly not carrying out an item in their service plan that suggests the PMD build certain recerational facilities. On the one hand KCRMD believes that the service plan of the PMD is not subject to change and is willing to sue, at great expense to our residents. On the other hand they are willing to violate our service plan by threatening to close the Bradford pool. This is both hypocritical and manipulative. They cannot have it both ways. By deleting attorney fees, they can balance our budget, meet our service plan guidelines of and NOT require a tax increase to the residents.

"Follow the money!" This is the mantra of a good investigation. In your case, Mr. Wilson, I think you should focus on finding the REAL money: the missing $3.5M that has sparked the PMD lawsuits of late. THESE are the outside forces working against Ken Caryl Ranch. PMD is nervous about the June court date and what might result from that investigation. Perhaps someone will have to repay the $3.5M?? In the meantime, we are simply citizens trying to make sure our amenities aren't shut down. I call that trying to "save our community." Please get back to us with your explanation of the missing $3.5M!
