Political signs not appropriate in Ken-Caryl

The Ken Caryl Ranch Master Association is in violation of it's covenants that do not allow signs on home owner's association-owned property.

Today there are at least 18 signs for the vote yes campaign only, on our HOA owned properties on Ken Caryl Avenue, Chatfield, and many other high traffic locations.

The MA should be neutral, especially since this tax increase was voted down in November, by a margin of almost 55%, and the people who voted "no" pay HOA dues, too.

This is also a conflict of interest since all the commercial properties in Ken-Caryl Ranch pay dues to the MA, and about 2/3 rds of them are located in Plains Metro District, and are therefore involved in the lawsuit between KCRMD and Plains. So the people in Plains (who are also members of the MA, the umbrella HOA organization) are helping fund the campaign to increase taxes. This is not fair representation. This tax money is used by KCRMD to pay legal fees to fund the lawsuit against Plains. There is also a $112,000 gift the MA will give the KCRMD if the tax increase passes.

The MA is not representing either the commercial property owners, or the home owners who will vote no, who collectively pay the majority of the total dues collected by the MA.

The KCRMA also paid to design, print, and mail postcards to all the people
that pay dues (even those not registered to vote) to the HOA, saying to vote for both of the tax increase initiatives, A and B. Yet they have not formedan issues committee as required by the fair campaign laws. Is this also a mis-appropriation of funds?

I believe these are federal offenses against the fair campaign practices laws and a violation by the MA of the covenants it's very purpose is to enforce.

Is this also a violation of our First Amendment rights to free speech?

The vote yes campaign is also criminally trespassing by removing our vote no campaign signs, alleging that they are on right of ways.

Ms. Tourney, It's well-known what you and your fellow PMD business owners are fighting for!! The cards are stacked against you this time because the FACTS have been communicated. As citizens conclude their voting today, the message will be clear: Let the lawsuit come to its natural conclusion, let the PMD pay back what they took and let our community continue to operate in the way it was designed. I hope that your attacks and vitriol will finally be silenced after the citizens have spoken.

Kathy; What an accurate and great article. The bias thatis being shown by the MA to the vote yes group only reinforces that the MA is not representing all the home owners. It took the threat of a law suit against the MA board to have them remove the unfair and unethical placement of vote yes signs on HOA property. This isn't the kind of board members I want representing our community. Keep up the good work, we support you.
