Longmont railroad quiet zones


In the 9/1/2009 presentation on Railroad Quiet Zones, Nick Wolfrum (a city employee) suggested that the funding for a study of the Railroad Quiet zones come from savings in the Capital Projects (CIP) from the street fund.

The ordinance for raising the Street Improvement Fund (Q-2005-62) clearly states that the funds raised under the ordinance be used "only for street improvements and maintenance". Using any monies raised for 'Street Improvement and Maintenance' for any purpose no matter how noble appears to violate the City Ordinance. In that money is fungible, once the money is designated as Street improvement & Maintenance it shouldn't be taken out for any other purpose...

How can the City of Longmont violate its own ordinances?
