A new group know as
'Free Marijuana in Longmont' has formed to change the Longmont city code.
The existing code, never revised since 1995, does not take the state's decriminalization in 2001 into it code, nor does it abide by amendment 20 of the Colorado constitution. Even defendants with state certified medical marijuana permits are subject to fines and imprisonment in Longmont.
Rather than force a complete re-write of LongmontCity code in reference to changes made by the state legislature and state wide voters,
Free Marijuana in Longmont simply proposes to
change the offense of possession of an ounce or less to a $5 maximum and remove the possibility of jail.
Free Marijuana in Longmont also wants to insure that the code reform is aimed at adult possession, and that people under the age of 18 are dealt with in accordance with other laws for juveniles.
The group also finds that 'public display' where marijuana users and legalization advocates seek to create pubic events by smoking marijuana in openly observed areas, creates disorder and is attractive to law enforcement. Therefore, in reforming the Longmont code, Free Marijuana in Longmont reduces the fine to $25 rather than to $5. However, the
15 day jail sentence is removed and replaced with community service.
The use of any kind of non prescription drugs while driving is a separate offense and these proposed changes have no effect on those state laws.
These proposed revisions of the Longmont Municipal code are intended to re-direct law enforcement and our court away from adult marijuana users. Law enforcement and prosecutor s has a great number of serious things to attended to.
Free Marijuana in Longmont would like to free up their time to do those things and disregard minor marijuana possession.
Volunteers are needed collect petition signatures. Petition collectors only need to be 18 years of age and US citizens. They do not need to be from Longmont.
No one can interfere with a petitioners, including the police. There is no risk for collecting signatures.

The proposed new code follows:
10.36.110 Possession or consumption prohibited.
A.It is unlawful knowingly to possess up to one ounce of marijuana.
The court shall punish adult offenders by a fine of no more than five dollars.
The court shall punish minor offenders by a fine between fifty and one hundred dollars. Upon any subsequent conviction of a minor within twelve months, the fine shall be one hundred dollars, plus applicable court costs.
B.It is unlawful to openly and publicly display, consume or use up to one ounce of marijuana. The court shall punish offenders by a fine of twenty-five dollars; of by up to ten hours of community service; or both.
Upon any subsequent conviction within twelve months, the fine shall be fifty dollars, and no more that twenty hours of community service.
C.As used in this section, unless the context otherwise requires:
1.An Adult is defined as a person who is eligible to vote in the United States.
2.A Minor is defined as a person who is less than the age of eighteen.
