Town of Morrison Board of Trustees Ordinance No. 3

AN ORDINANCE APPROVING AND AUTHORIZING AN INTERGOVERNMENTAL AGREEMENT WITH THE CITY AND COUNTY OF DENVER FOR USE OF DENVER MOUNTAIN PARKS PROPERTY BY MORRISON FOR A WATER TREATMENT FACILITY AND DECLARING AN EMERGENCY

WHEREAS, the Town of Morrison has used and occupied property (the "Property") at Denver Mountain Parks Headquarters for its Water Treatment Facility (the "Facility") for many years; and

WHEREAS, the current agreement for use of the Property expires in 2023; and

WHEREAS, Morrison wishes to extend the current agreement until 2050 and obtain consent to the enlargement of its existing facility; and

WHEREAS, Morrison and Denver have agreed to enter into a new Intergovernmental Agreement permitting Morrison to enlarge the existing facility and occupy the Property until the year 2050.

NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES FOR THE TOWN OF MORRISON, COLORADO:

Section 1. The Board of Trustees hereby approves and authorizes the Mayor of the Town of Morrison to execute and the Clerk to attest that Intergovernmental Agreement between the Town of Morrison and the City and County of Denver Regarding the Water Treatment Facility at Denver Mountain Parks Headquarters.

Section 2. The Board of Trustees hereby authorizes the Town Attorney to agree to minor changes in form or substance not enlarging or modifying the Town's obligations or reducing its rights or benefits under the Intergovernmental Agreement prior to its execution by the Mayor.

Section 3. An Emergency is declared and this Ordinance shall be effective immediately upon its adoption and execution by the Mayor as the proposed Intergovernmental Agreement was received only a short time ago, Denver must yet act upon it, and construction of the Facility is delayed until formal approval by both parties potentially resulting in substantial cost increases to the Town and delay in improving drinking water quality adversely impacting the public health and financial well being of the Town.

INTRODUCED, READ, ADOPTED AND ORDERED PUBLISHED this 5th day of June, 2007, by a vote of 5 aye and 0 nay.
