Planned Unit Development - P.U.D

Planned Unit Developments are formed in order to encourage the flexibility of the development of land that may be necessary to permit adjustment to changing public and private needs; to foster the ability to provide development patterns which are more compatible with and effective in meeting such needs; to promote the efficient use of land so as to preserve and enhance the natural characteristics and unique features of the property; to improve the design, character and quality of new development; to encourage integrated planning to achieve the objectives of the Comprehensive Plan; to preserve open areas; to facilitate the adequate and economical provisions of streets and utilities and to reduce the burden on existing streets and utilities by more efficient development; and to conserve the land value. The PUD is an entire development concept and shall be reviewed as a whole.

The PUD shall set forth the provisions for development, including but not limited to easements, covenants and restrictions relating to use, location, and bulk of buildings and other structures; intensity of use or density; utilities; private and public streets, ways, roads, pedestrian areas, and parking facilities; common open spaces; and other public facilities.

Ownership and maintenance of the common areas designated for the enjoyment of residents shall be the responsibility of a Homeowners Association and / or Architectural Control Committee. The PUD is beneficial through the interconnected Open Space.

The development will not have a material adverse impact on the surrounding area and will be in harmony and compatible with the neighborhood. Compatibility includes but not limited to size, scale, mass, architectural design, and landscaping. The development will not cause significant air, water, or noise pollution and will not result in erosion of slopes or geographic hazard areas. Fire hazards will not be created or increased or adversely affect any land of significant historical, cultural, recreational, or aesthetic value. The PUD will not otherwise be detrimental to the health, safety, or welfare of the present or future inhabitants of the County.

The Planning Commission may impose reasonable conditions and safeguards to insure compliance with these regulations.

“A chief goal in planning a public space is to create activity and synergy between the elements in the space and among the people using the space. To achieve this, triangulation - the idea that elements in relationship to each other will stimulate linkages between people and places. The whole thing is like a mosaic. Each piece needs to be carefully considered. If it is all done right, all these things come together to create a neighborhood.”
