Sharing the Road...Vehicles and Pedestrians

With the arrival of spring and nice weather we are seeing more pedestrians out and about. This brings up a safety issue when it comes to pedestrians and vehicles sharing the road, namely at crosswalks. The Northglenn police department wants to make sure all pedestrians and drivers are clear about the laws involving a pedestrians right-of-way in crosswalks.

Model Traffic Code Section 802 states: "When traffic control signals are not in place or not in operation, the driver of a vehicle shall yield the right-of-way, slowing down or stopping if need be to so yield, to a pedestrian crossing the roadway within a crosswalk when the pedestrian is upon the half of the roadway upon which the vehicle is traveling or when the pedestrian is approaching so closely from the opposite half of the roadway as to be in danger." This means that if there is a pedestrian in the crosswalk, you must stop and allow that person to finish crossing the street. Drivers convicted of failing to yield to pedestrians face a minimum fine of $130 plus points assessed against their driver's license.

The traffic code also states, under the same Section, that "No pedestrian shall suddenly leave a curb or other place of safety and walk or run into the path of a moving vehicle which is so close as to constitute an immediate hazard." When at a signalized intersection, pedestrians shall comply with the traffic control devices provided. A pedestrian also has obligations and may not just run out into traffic or in front of a car and expect them to stop. Pedestrians convicted of failing to obey a traffic control device face a minimum fine of $30.

Essentially, what these laws say is "please be nice and aware of each other when using the public roadways." A little courtesy goes a long way to making sure everyone gets where they are going, safely.

That is nice but what does that law say about pedestrians in a store parking lot. Most people I have observed just walk out like the owned the road and look neither way. Like they are expecting the driver to see them. It is a wonder that we do not have more accidents in parking lots the way people look neither way.
