There should be little doubt that the values of foremost importance to the Framers of many provisions of the Constitution encompass the protection of economic and property rights.
The Constitution of the United States of America protects us against discriminatory treatment. These are the rights of most native born citizens to make and enforce contracts and to inherit, purchase, lease, sell, hold, and convey real or personal property. No state shall make or enforce any law with shall abridge the privileges, or immunities of citizens of the United States. Nor shall any State deprive of life, liberty and the pursuit of happiness without the due process of law.
Ex post facto laws operate retroactively to the detriment of private owners of an interest acquired under prior laws. We are left to use the laws already in place, or to "grandfather" in the exceptions.
The deterioration of the economy has led to an array of legislative schemes. Has denied many people the fundamental liberty in a society dedicated to liberty and the opportunity to engage in business, economic activity. The springs of industry have been relaxed because of the failure to safeguard our commercial freedoms.
Because our freedom and prosperity depend upon it, to the extent all things are possible, the times should be kept in time with the Constitution.
