Dear neighbor: Remove this shed on sticks


I am a resident of Antelope Heights, a Parker subdivision. We are controlled/governed by Covenants, Conditions & Restrictions, and Design Guidelines. These are to be enforced by the Homeowners Board of Directors.

The attached photo is a structure which was built by my neighbor, Vincent Curran, sometime in 2008, and added to over a 10 month period. This is the view from my living room. I believe the picture speaks for itself. More importantly, I do no believe it is in compliance with our guidelines which state, in part, that a structure will be evaluated on merit, location on the lot, and appearance...structures should be placed to avoid unreasonable influence into neighboring yards.

At the end of July, our management company severed ties with our Association, but not before I had the opportunity to access the Homeowner files there. No evidence could be produced to confirm approval of this construction. There was, however, a copy of a letter of non-compliance which had been sent to Mr. Curran. No follow up documents could be found.

On May 6, 2009, Mr. Curran submitted a request to become a member of the Board and was accepted. A letter from the management company, dated May 11, 2009, arrived at my home stating that the structure was now approved, although no changes had been made in the interim. Again, no documentation can be produced to verify this approval. The management stated that nothing had been provided to them by the Board of Directors.

Since October, 2008, I have tried, privately, to go through proper procedures to get a response from the Board of Directors for a solution. All correspondence has gone virtually unacknowledged. A letter sent directly to Mr. Curran has also gone unanswered.

During this period of time, Lee Fiechtner has been the President of the Board. The Vice President has been Sean Morrissey. On August 1, 2009, Mr. Morrissey stepped down from his position. Then, effective immediately, the Board of Directors, autonomously signed a contract with a new management company. The owner of that management company.... Sean Morrissey. Although I am told that there is nothing illegal about this, I strongly question the ethics involved. On a more personal level, given this development, I also question whether there will be a change in responsiveness, accountability and enforcement of our covenants and guidelines. Or, will I continue to be treated with the same disregard while requesting a removal of this shed on sticks looming over my privacy fence?
