Arguments against homeowners associations

The trouble with associations is that, DEEP DOWN, Americans don't believe in them. The are not founded on LIBERTY, and JUSTICE FOR ALL. They are not founded on the proposition that all men are created equal. And they are definitely not founded to ensure domestic tranquility.
In the process, many fundamental rights that Americans hold dear are signed away. Little things like PRIVATE PROPERTY rights, DUE PROCESS, and ACCESS to GOVERNMENT, dictating a whole range of lifestyle restrictions.
* The rules are not written by a duly elected body.
* The "right to privacy" merely provides that the association shall reasonably "minimize intrusions into the privacy of individual units, individual affairs and personal records", as appropriate, and "in light of needs and circumstances."
* The government is elected by the property owners.
* The board LEVIES the fines for breaking the rules, and it functions as judge and jury for appeals.
This does not include any rights to an independent judiciary. This leaves the association board with the power to make the rules, charge people with violating them, and TRY the violators. The accused has merely the right to "notice and an opportunity to be heard."

I couldn't agree more. When you finally find the house you are looking for, you are more concerned with getting a good price, getting a thorough inspection, getting financed. You see the HOA papers but don't read them as closely as you should. You figure that everyone else in the neighborhood is under the same rules, so it cant be anything out of the ordinary. But just wait till you don't have your Christmas lights taken down by the middle of January. First notice of the gestapo. No matter that it is near zero. Submit to the all powerful HOA. Give me freedom, please.
