Small bar owners want smoking ban exception

The Colorado Licensed Beverage Association (CLBA) held a press conference at the state capitol building on Feb. 16 to encourage an amendment to the smoking ban legislation in order to exempt small neighborhood bars.

Speaking in favor of an amendment were State Senators Ed Jones and Andy McElhaney. It was suggested that taverns which sell less than 25 percent of their gross on food be exempt from the ban.

If the ban were to pass, smokers could go outside the bars where they would not be under the control of the staff, fights could break out, and this could be a bigger nuisance for police and neighbors than current smoking in bars.

Smoking is legal in Colorado. If it would be illegal in most public places, this would place an unfair burden on our police. If the ban exempts casinos, why not neighborhood bars? One senator commented that there are over 8,000 employees in casinos in Colorado. People choose where they work, whether it be casinos or neighborhood bars.

Non-smokers make their own decisions as to whether to go into smoking establishments. A large percentage of tavern customers are smokers. Most tavern owners sell very little food. Small tavern business owners will lose revenue and the state and cities will lose tax revenues if a ban does not exempt their customers.
